$4,370,000 – Medical Malpractice/Negligence; Wrongful Death
Facts
The patient was admitted to the hospital and placed under the care of hospital staff and treating physicians responsible for monitoring the patient’s condition. During the course of care, the patient developed abnormal clinical findings and worsening vital signs that indicated a potentially life-threatening condition. Healthcare providers did not recognize or respond to these changes. The patient’s condition continued to deteriorate, and a cardiac event followed, resulting in death.
Allegations/Contentions
Plaintiff alleged that the abnormal clinical findings, worsening vital signs, and other indicators of the patient’s declining condition required heightened monitoring, intervention, and escalation of care.
According to the lawsuit, the failure of hospital personnel and physicians to recognize and respond to these signs allowed a preventable cardiac event to occur. Experts retained by the plaintiff concluded that accepted standards of medical care required earlier recognition of the patient’s deteriorating condition and timely intervention to prevent catastrophic injury.
Injuries/Damages
The patient suffered a fatal cardiac event. Plaintiff brought claims for wrongful death, negligence, negligent infliction of emotional distress, and survival damages on behalf of the surviving spouse and the patient’s estate.
Special Notes
